A no-pocher agreement is a little different: it prevents the worker from soliciting businesses from the employer`s customers or inviting the employer`s other employees to join the competitor, usually for the same period as the non-compete clause. These agreements also prevent an employee from taking over the employer`s valuable information, including their trade secrets, customer lists, and pricing information. In Illinois, an employer sued an employee for violating its no-pocher agreement for sending LinkedIn login requests to his former clients and co-workers. However, the court sided with the employee on the grounds that LinkedIn`s requests were generic and that customers or employees did not solicit directly.
